Terms of service
TERMS OF SERVICE
OVERVIEW
This website is operated by 94 Apparel Ltd. Throughout the site, the terms “we”, “us” and “our” refer to 94 Apparel Ltd.
These Terms of Service govern your use of our website and the purchase of products from us. By using our website or placing an order, you agree to these Terms together with any other policies referred to on our website.
Nothing in these Terms affects your statutory rights as a consumer.
1. ABOUT US
94 Apparel is operated by:
94 Apparel Ltd
Company number: 14506637
Registered office: Unit 1, The Counting House, Sandy Lane, Ettiley Heath, Sandbach, CW11 3NG, United Kingdom
Email: info@94apparel.com
94 Apparel Ltd is registered in England and Wales.
We are not currently VAT registered.
2. OUR PRODUCTS
94 Apparel creates limited-run clothing and apparel.
Our products are generally released in limited drops, with around 50 pieces of each design produced. Quantities may vary between products and releases.
Once a product or size has sold out, we do not guarantee that it will be restocked.
Where applicable, individual pieces may be numbered to identify them as part of a particular limited release.
We make reasonable efforts to display our products accurately. However, colours and appearance may vary slightly depending on your device, screen settings and photography.
Product measurements and sizing information are provided as a guide. Please check the relevant product information before ordering.
3. ORDERS
When you place an order through our website, you are making an offer to purchase the products in your order.
Receiving an order confirmation does not necessarily mean that we have accepted your order. A contract between you and 94 Apparel Ltd is formed when we accept and process your order.
We reserve the right to refuse or cancel an order where reasonably necessary, including where:
-
a product is unavailable;
-
there has been an obvious pricing or product information error;
-
we are unable to obtain authorisation for payment;
-
we reasonably suspect fraudulent activity; or
-
we are unable to fulfil the order.
If we cancel an order after payment has been taken, we will refund the relevant amount.
Please ensure that the information you provide when ordering, including your delivery address and contact details, is accurate.
4. LIMITED DROPS & AVAILABILITY
94 Apparel operates differently from a traditional continuously stocked clothing retailer.
Our releases are intentionally limited and products may sell out quickly.
Adding an item to your basket does not reserve it. An item may become unavailable before checkout is completed.
Because of the limited nature of our releases, we cannot guarantee that an alternative size or replacement product will be available if you request an exchange.
Where an exchange cannot be provided, any return or refund due will be handled in accordance with our Return & Refund Policy and your statutory rights.
5. PRICES & PAYMENT
All prices displayed on our website are shown in pounds sterling (£) unless stated otherwise.
94 Apparel Ltd is not currently VAT registered.
Delivery charges, where applicable, will be shown during checkout before you place your order.
Payment must be made using one of the payment methods available at checkout.
We take reasonable care to ensure prices are accurate. If we discover an obvious pricing error after an order has been placed, we may contact you to give you the option of purchasing the product at the correct price or cancelling the order for a refund.
6. SHIPPING & DELIVERY
We will deliver orders to the address provided during checkout.
Available delivery methods, prices and estimated delivery times will be displayed at checkout and/or in our Shipping Policy.
Delivery times are estimates unless we expressly agree otherwise.
We are not responsible for delays caused by circumstances genuinely outside our reasonable control. However, nothing in these Terms limits any rights you have under applicable consumer law regarding delivery.
Risk in the goods remains with us until the goods come into your physical possession, or the physical possession of a person you identify to receive them, except where applicable law provides otherwise.
Please see our Shipping Policy for further information.
7. RETURNS, CANCELLATIONS & REFUNDS
Your rights to cancel an online order and return products are explained in our Return & Refund Policy.
For eligible online purchases, consumers generally have a statutory right to cancel within 14 days after receiving the goods.
Our limited quantities and individually numbered products do not remove your statutory consumer rights.
Change-of-mind and sizing returns are subject to the conditions explained in our Return & Refund Policy.
This does not affect your legal rights where products are faulty, damaged, not as described or otherwise fail to conform to the contract.
Please see our Return & Refund Policy for full details.

13. FAULTY OR MISDESCRIBED GOODS
Products supplied by us must meet the standards required by applicable UK consumer law.
Nothing in these Terms excludes or restricts your statutory rights relating to goods that are faulty, not of satisfactory quality, not fit for purpose or not as described.
If you believe you have received a faulty or incorrect item, contact us at info@94apparel.com.
14. OUR LIABILITY
Nothing in these Terms excludes or limits liability where doing so would be unlawful.
In particular, nothing in these Terms excludes or restricts liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory rights in relation to goods supplied by us.
If you are purchasing as a consumer, we are responsible for losses that are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that were not reasonably foreseeable when the contract was formed.
Products sold through our consumer store are intended for personal use. We are not responsible for business losses, including loss of profit, revenue, business or business opportunity, arising from a consumer purchase to the extent permitted by law.
15. EVENTS OUTSIDE OUR CONTROL
We will not be responsible for a failure or delay in performing our obligations where that failure or delay results from circumstances outside our reasonable control.
Where such circumstances materially affect an order, we will take reasonable steps to minimise the impact and will contact you where appropriate.
Your statutory rights are not affected.
16. CHANGES TO THESE TERMS
We may update these Terms from time to time, for example to reflect changes to our business, website or applicable law.
The Terms applying to your purchase will normally be those in force when your order was placed.
The latest version of these Terms will be available on our website.
17. GOVERNING LAW
These Terms are governed by the laws of England and Wales.
If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from mandatory protections available to you under the law applicable where you live.
Nothing in this section removes any rights you may have to bring proceedings in a court available to you under applicable consumer law.
18. SEVERABILITY
If any provision of these Terms is found to be unlawful or unenforceable, that provision will be treated as removed or limited to the extent necessary without affecting the remaining provisions.
